Petitioner was employed by the relator Noble Realty Company to paint the cornices and some other parts of a building owned by it. Petitioner was a skilled journeyman painter. He was not a contractor and had never taken job contracts. A written contract for the work was entered into. Petitioner was to furnish his own tools and receive a lump sum for doing the work. This lump sum was arrived at by figuring union scale wages for the estimated time required to do the work. The realty company was to furnish the material, the paint to be used. It retained full control as to the kind, quality, and color of the paint, and final color was subject to its approval. During progress of the work the realty company gave directions as to what color of paint should be applied to certain parts of the structure and gave some directions as to other parts of the work. It is held that the finding of the referee and commission that petitioner was an employe of the realty company and not an independent contractor is sustained by the evidence.
